TURF WARZ
EARLY ACCESS AGREEMENT
Effective Date: March 27, 2026
This Early Access Agreement ("Agreement") is a supplemental agreement between you and Turf Warz LLC, a Colorado limited liability company ("Turf Warz," "we," "us," or "our"), that governs your participation in the early access period of the Turf Warz mobile application and any related services (the "Service").
This Agreement supplements — and does not replace — our Terms of Service, Privacy Policy, and Community Guidelines (collectively, the "Core Agreements"). By using the Service during early access, you acknowledge that you have read, understood, and agree to be bound by this Agreement and all Core Agreements. If you do not agree to any part of this Agreement or the Core Agreements, do not use the Service.
In the event of any conflict between this Agreement and the Core Agreements, this Agreement controls for the duration of the early access period.
The Service is in active development. You are participating in an early access release, not a finished product. The Service is being made available to a limited number of users for the purpose of testing, gathering feedback, and iterating on gameplay, features, and infrastructure before a wider public release.
By participating in early access, you understand and accept that:
Our Terms of Service, Privacy Policy, Community Guidelines, and Game Guide describe the intended vision for the Service. They do not constitute a guarantee that any specific feature, mechanic, or capability described in those documents is currently available, fully functional, or will ever be implemented.
During early access:
All software contains bugs. This is an inherent reality of software development, and it applies to the Service regardless of its development stage. During early access, the likelihood and frequency of bugs is higher than in a mature product.
You understand and accept that the Service may:
We will make reasonable efforts to identify and fix bugs, but we do not guarantee that any specific bug will be fixed or that the Service will ever be entirely free of defects.
During early access, your data and gameplay progress are not guaranteed to persist. As part of the development process, we may need to perform actions that affect your account and data, including but not limited to:
While we will make reasonable efforts to preserve your data and to notify you in advance of planned resets, we are under no obligation to do so. You should not rely on the permanence of any data, progress, or content stored within the Service during the early access period.
We strongly recommend that you do not make purchasing decisions, time investments, or other commitments based on the assumption that your early access data or progress will carry over to the general release of the Service.
The Service may be taken offline, interrupted, degraded, or made entirely unavailable at any time and for any duration, with or without notice, for reasons including but not limited to:
We do not guarantee any minimum level of uptime, availability, or performance during the early access period. The Service is not intended for mission-critical use and should not be relied upon for any purpose where unavailability would cause harm.
We welcome and encourage feedback, suggestions, bug reports, and ideas from early access participants. You may submit feedback through the in-app reporting tools or by contacting us at [email protected].
By submitting any feedback, suggestions, ideas, bug reports, or other communications to Turf Warz in connection with your use of the Service ("Feedback"), you grant Turf Warz a non-exclusive, perpetual, irrevocable, transferable, sublicensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, distribute, and otherwise exploit such Feedback for any purpose, without compensation, attribution, or obligation to you. You acknowledge that Turf Warz is under no obligation to use, respond to, or implement any Feedback you provide.
If you discover a bug, exploit, or vulnerability in the Service, please report it to us rather than exploiting it or sharing it with others. Responsible disclosure is both expected and appreciated.
THE DISCLAIMERS IN THIS SECTION SUPPLEMENT AND DO NOT REPLACE THE DISCLAIMER OF WARRANTIES IN SECTION 16 OF OUR TERMS OF SERVICE. ALL DISCLAIMERS IN THE TERMS OF SERVICE APPLY IN FULL DURING THE EARLY ACCESS PERIOD.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED DURING THE EARLY ACCESS PERIOD ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TURF WARZ LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS MAKE NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SERVICE, INCLUDING BUT NOT LIMITED TO:
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE DURING EARLY ACCESS IS AT YOUR SOLE RISK. YOU ARE VOLUNTARILY PARTICIPATING IN AN UNFINISHED PRODUCT AND ASSUME ALL RISKS ASSOCIATED WITH THAT PARTICIPATION.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
THE LIMITATIONS IN THIS SECTION SUPPLEMENT AND DO NOT REPLACE THE LIMITATION OF LIABILITY IN SECTION 17 OF OUR TERMS OF SERVICE. ALL LIABILITY LIMITATIONS IN THE TERMS OF SERVICE APPLY IN FULL DURING THE EARLY ACCESS PERIOD.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TURF WARZ LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE EARLY ACCESS PERIOD, INCLUDING BUT NOT LIMITED TO:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TURF WARZ'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR PARTICIPATION IN EARLY ACCESS SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00 USD) OR (B) THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO TURF WARZ IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, TURF WARZ'S LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
The indemnification obligations in Section 18 of our Terms of Service apply in full during the early access period. In addition, you agree to defend, indemnify, and hold harmless Turf Warz LLC and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your continued use of the Service after any changes to this Agreement constitutes your acceptance of the updated terms. If you do not agree to the changes, you must stop using the Service.
Turf Warz is a location-based game that requires you to walk outdoors with your dog in the real world. By participating in early access, you expressly acknowledge and assume the following risks:
You are solely responsible for your own safety and the safety and wellbeing of your dog at all times while using the Service. No gameplay objective, territory claim, leaderboard position, or competitive goal is worth compromising your safety or your dog's safety.
During early access, you may be exposed to features, designs, mechanics, or other aspects of the Service that have not been publicly released. While we do not impose a formal non-disclosure obligation, we ask that you exercise good judgment and refrain from publicly sharing details about unreleased features, internal communications from the Turf Warz team, or other information that is clearly intended for early access participants only.
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. To the extent any dispute arising under this Agreement is not subject to arbitration under Section 19 of our Terms of Service, you and Turf Warz agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Denver, Colorado.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND TURF WARZ EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT.
Severability. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
Entire Agreement. This Agreement, together with the Terms of Service, Privacy Policy, and Community Guidelines, constitutes the entire agreement between you and Turf Warz regarding your participation in early access and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written, regarding the same subject matter.
Waiver. The failure of Turf Warz to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Turf Warz.
Assignment. You may not assign or transfer this Agreement or any rights or obligations under it without the prior written consent of Turf Warz. Turf Warz may assign this Agreement at any time without notice or consent.
Survival. Sections 7 (Feedback), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 14 (Governing Law), and 15 (General Provisions) shall survive the termination or expiration of this Agreement and the early access period.
