1. Introduction and Scope

This Privacy Policy explains how Turf Warz LLC, a Colorado limited liability company (“Turf Warz,” “we,” “us,” or “our”), collects, uses, shares, and protects your personal information when you use the Turf Warz mobile application and any related services (collectively, the “Service”). It also explains your rights and choices regarding your personal information.

This Privacy Policy applies to all users of the Service in the United States, excluding California. California residents should refer to a separate California Privacy Notice which will be published at a later date. By using the Service, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree, please do not use the Service.

This Privacy Policy is incorporated into and forms part of our Terms of Service. Capitalized terms used but not defined here have the meanings given in our Terms of Service.

2. Information We Collect

We collect information in three ways: information you provide directly to us, information collected automatically when you use the Service, and information collected by third-party services operating within the Service.

Information You Provide Directly

Account Information — When you create an account, we collect your username, email address, and password. If you create a family account, we also collect the usernames and ages of family members you add to the account.

Dog Profile Information — For each dog you register, we collect your dog’s name, breed, age, weight, and any photos you choose to upload. You may also provide optional information such as personality traits. Dog profiles are the primary identity within the Service. There are no separate human profiles.

User Content — Any content you post to the social feed, including photos, walk summaries, and captions, is collected and stored by us. You control the audience for this content through your Walk Share Default privacy setting.

Communications — If you contact us for support or other purposes, we collect the content of your communications and any information you provide in connection with them.

Sponsored Challenge Participation — If you choose to participate in a sponsored challenge, we may collect additional information required to fulfill the challenge reward, such as a shipping address or email address, which may be shared with the sponsoring brand as described in Section 6.

Information Collected Automatically

Location Data — When you use the Service, we collect precise GPS location data from your device to enable core gameplay features including territory marking, walk tracking, and map visualization. Location data is collected only while the app is in use and only with your permission. We do not collect location data in the background when the app is not in use. The specific nature of our location data collection and how it is used is described in detail in Section 4.

Walk and Fitness Data — We collect data about your walks including distance, duration, route, start and end times, speed, and estimated calories burned. This data is associated with your account and used to calculate gameplay scores, leaderboard standings, and fitness metrics.

Device Information — We automatically collect information about the device you use to access the Service, including device type, operating system, unique device identifiers, mobile network information, and app version.

Usage Data — We collect information about how you use the Service, including features you interact with, screens you visit, gameplay actions you take, settings you configure, and the frequency and duration of your sessions.

Log Data — Our servers automatically record certain information when you use the Service, including your IP address, access times, and app activity logs. This information is used for security, fraud prevention, and service reliability purposes.

Information Collected by Third-Party Services

Mapbox — The Service uses Mapbox to provide mapping and location features. When you use the map within the Service, Mapbox independently collects your IP address and processes location requests as an independent data controller. Mapbox’s collection and use of this data is governed by Mapbox’s Privacy Policy, available at mapbox.com/legal/privacy. We encourage you to review it.

Sentry — The Service uses Sentry for error monitoring and crash reporting. When the app encounters an error or crash, Sentry automatically collects diagnostic information including device identifiers, operating system details, app state at the time of the error, and may incidentally capture partial location or session data contained in error logs. Sentry’s collection and use of this data is governed by Sentry’s Privacy Policy, available at sentry.io/privacy. We encourage you to review it.

Apple App Store and Google Play — Purchases made through the Service are processed by the Apple App Store or Google Play. We do not receive or store your payment information. These platforms may share limited transaction information with us such as purchase confirmation and subscription status. Their collection and use of your data is governed by their respective privacy policies.

3. How We Use Your Information

We use the information we collect for the following purposes:

Aggregate and Anonymized Data

We may combine, anonymize, and aggregate information collected through the Service for any business purpose, including product development, research, and commercial data licensing. Anonymized and aggregated data cannot be used to identify you personally and is not subject to this Privacy Policy.

4. Location Data

Location data is central to the Turf Warz experience. This section explains in detail how we collect, use, store, and protect your location information.

How We Collect Location Data

We collect precise GPS location data from your device both while the app is actively in use in the foreground and while it is running in the background. We use GPS signals as the primary location method, supplemented by WiFi and cellular network data where available to improve accuracy.

Background location collection is used to continue tracking active walk sessions when you switch to another app or lock your screen mid-walk, and to enable family walk notifications that alert you when family members start or end walks. Background location is not collected when no walk session is active and you have not enabled family walk notifications.

Location collection requires your explicit permission through your device’s operating system. You will be asked to grant location permission when you first use the Service. For background location, your device’s operating system will request a separate “always on” or “allow while using” permission. You may change these permissions at any time through your device settings. If you revoke foreground location permission, core gameplay features including territory marking and walk tracking will not function. If you revoke background location permission, walk tracking will pause when the app is not in the foreground and family walk notifications will not work.

How Location Data Is Used in Gameplay

Your location data is used to record walk routes, calculate distances, enable territory marking, and determine circular territory claims around each marked location. Location data is also used to enforce gameplay rules including speed lock restrictions that disable territory marking at speeds inconsistent with walking or jogging.

Walk routes and territory claims are stored in association with your account and used to calculate your gameplay stats, leaderboard standings, and pack contributions.

Real-Time Location Is Never Shared

Your real-time location is never visible to any other user at any time. No other user can see where you are while you are walking. This is an absolute rule with no exceptions regardless of your privacy settings.

Post-Walk Location Sharing

Walk routes and territory claims are only made visible to other users after a walk session has been completed, and only in accordance with your Walk Share Default privacy setting. You choose when and whether to share any given walk to the social feed.

You may configure a Walk Obfuscation Radius of 0 to 1.0 miles, which blurs the start and end points of your walk routes on shared posts. We strongly recommend enabling walk obfuscation to prevent others from identifying your home address or other frequently visited locations from your walk data.

Location Data Retention

We retain your walk route and location history for as long as your account is active. You may delete individual walks from your account history at any time within the app. Upon account deletion, your location and walk data will be deleted in accordance with Section 9.

Mapbox and Location Processing

When your device requests map tiles or processes location data through Mapbox, Mapbox independently receives and processes your IP address as described in Section 2. Mapbox does not receive your precise GPS coordinates directly — map tile requests are based on general map viewport rather than your exact position.

Location Data and Anti-Cheat

We analyze location data patterns to detect GPS spoofing, impossible movement speeds, and other forms of gameplay manipulation. This analysis is conducted automatically and may result in account investigation or suspension as described in our Terms of Service.

5. Dog and Family Account Data

Dog Data

Dog profiles are the primary identity within the Service. We collect and store information about each dog registered to your account including name, breed, age, weight, personality traits, photos, gameplay stats, walk history, territory data, leaderboard standings, and pack contributions. This information is used to operate the Service, display your dog’s profile to other users in accordance with your privacy settings, and calculate gameplay scores.

If you delete a dog profile, the following applies: territory claims associated with that dog are removed from the shared game state; the dog’s profile, photos, and identifying information are permanently deleted; social feed posts and comments made under that dog’s profile remain in the Service but are disassociated from the dog and displayed without a dog attribution; and leaderboard entries associated with that dog remain but are displayed without a dog attribution. If you wish to fully remove all content associated with a deleted dog, you must manually delete individual posts and comments before deleting the dog profile.

Dog photos you upload may be visible to other users according to your Territory Masking and Profile Visibility settings. If Territory Masking is set to Full, your dog’s photo will appear on your claimed territory on the shared map. If Territory Masking is set to Anonymous, a generic icon is shown instead.

Family Account Data

Family accounts allow a parent or legal guardian to add family members and manage their participation in the Service. The family account holder has full visibility into all activity, walk data, privacy settings, and gameplay data associated with every account in the family group. This includes walk routes, territory claims, social feed posts, and buddy interactions of all family members.

Family members added to a family account do not have independent accounts. Their data is stored under and associated with the family account. If the family account is deleted, all associated family member data is also deleted.

We collect the username and age of each family member added to a family account. We use age information to ensure that users under 13 are not permitted to create or use accounts independently of a family account, in accordance with our Terms of Service and applicable law.

Minor Data

We do not knowingly collect personal information from children under 13 outside of a family account created and managed by a parent or legal guardian. Within a family account, the parent or legal guardian is responsible for all data associated with minor family members. We do not use the personal data of minor family members for any commercial purpose including sponsored challenges or promotional communications without verifiable parental consent.

If you believe we have inadvertently collected personal information from a child under 13 outside of a properly established family account, please contact us immediately at [email protected] and we will take prompt steps to delete that information.

6. How We Share Your Information

We do not sell your personal data. We do not share your personal data with third parties for advertising or marketing purposes. We share your information only in the circumstances described below.

With Other Users of the Service

Certain information is visible to other users of the Service in accordance with your privacy settings. This includes your dog’s profile, territory claims, leaderboard standings, social feed posts, and pack membership. You control the scope of this visibility through the privacy settings described in our Terms of Service. Your real-time location is never shared with other users under any circumstances.

With Service Providers

We share information with third-party companies and individuals that perform services on our behalf, including cloud hosting, data storage, error monitoring (Sentry), mapping services (Mapbox), customer support, and analytics. These service providers are permitted to use your information only to perform services for us and are contractually required to protect your information in a manner consistent with this Privacy Policy.

With Sponsored Challenge Partners

If you choose to participate in a sponsored challenge, we may share limited personal information with the sponsoring brand solely for the purpose of fulfilling the reward you have earned. This may include your email address or shipping address depending on the nature of the reward. We will always notify you of what information will be shared before you complete participation in any sponsored challenge. Sponsored challenge partners are prohibited from using your information for any purpose other than fulfilling your reward.

Aggregate and Anonymized Data

We may share anonymized and aggregated data that cannot be used to identify you with third parties for commercial purposes including research, product development, and data licensing. This data may include aggregate walking patterns, territory activity trends, neighborhood usage statistics, and other de-identified gameplay data.

For Legal Reasons

We may disclose your information if we believe in good faith that such disclosure is necessary to comply with applicable law or a valid legal process including a court order, subpoena, or government request; to protect the rights, property, or safety of Turf Warz, our users, or the public; to detect, prevent, or investigate fraud, security issues, or technical problems; or to enforce our Terms of Service.

In Connection With a Business Transfer

If Turf Warz is involved in a merger, acquisition, sale of assets, financing, reorganization, or bankruptcy, your information may be transferred as part of that transaction. We will notify you via in-app notification of any such transfer and any material changes to how your information is handled as a result.

With Your Consent

We may share your information with third parties in ways not described above when we have obtained your explicit consent to do so.

7. Third-Party Services

The Service integrates with third-party services that may independently collect and process your information. This section describes each third-party service we use, what data they collect, and where to find their privacy policies. Turf Warz is not responsible for the privacy practices of any third-party service. We encourage you to review the privacy policies linked below.

Mapbox

We use Mapbox to provide mapping, location visualization, and territory display features within the Service. When you interact with the map, Mapbox processes location-related requests and independently collects your IP address. Mapbox acts as an independent data controller for the data it collects and is not a service provider acting on our behalf for that data. Mapbox does not receive your precise GPS coordinates from us — map tile requests are based on general map viewport. Mapbox’s data practices are governed by the Mapbox Privacy Policy at mapbox.com/legal/privacy.

Sentry

We use Sentry for application error monitoring and crash reporting. When the app experiences an error or crash, Sentry automatically captures diagnostic information to help us identify and fix the problem. This may include your device type, operating system version, app version, device identifiers, a snapshot of app state at the time of the error, and potentially partial session or location data present in error logs at the time of the crash. Sentry processes this data as a service provider on our behalf. Sentry’s data practices are governed by the Sentry Privacy Policy at sentry.io/privacy.

Apple App Store and Google Play

All in-app purchases and subscription billing are processed through the Apple App Store or Google Play depending on your device. We do not receive or store your payment card information. These platforms may provide us with limited transaction data such as purchase confirmation, subscription status, and renewal dates. Apple’s data practices are governed by the Apple Privacy Policy at apple.com/privacy. Google’s data practices are governed by the Google Privacy Policy at policies.google.com/privacy.

Future Third-Party Integrations

We may add additional third-party service integrations in the future. When we do, we will update this Privacy Policy to disclose those integrations and notify you via in-app notification before the changes take effect.

8. Data Sales and Sharing Disclosure

We Do Not Sell Personal Data

Turf Warz does not sell your personal data to any third party. We do not exchange your name, email address, location history, dog data, walk data, or any other information that identifies you personally for money or any other form of consideration.

We Do Not Share Personal Data for Advertising

We do not share your personal data with advertisers, ad networks, or data brokers for the purpose of targeted advertising or marketing by third parties. You will not receive targeted advertising from third parties based on data we have provided about you.

We Do Sell Anonymized and Aggregated Data

We may sell or license anonymized and aggregated data derived from user activity on the Service. This data is stripped of all personal identifiers and cannot reasonably be used to identify any individual user. Examples of the types of aggregated data we may sell or license include neighborhood walking activity trends, territory heatmap data, peak usage time patterns by geographic area, and similar de-identified datasets. This type of data licensing is standard practice in the location and mapping industry and does not expose your personal information.

Sharing With Sponsored Challenge Partners

As described in Section 6, if you choose to participate in a sponsored challenge, we may share limited personal information with the sponsoring brand solely to fulfill your reward. This sharing is voluntary — you are never required to participate in a sponsored challenge — and is disclosed to you before you complete participation.

Your Opt-Out Rights

Residents of certain U.S. states outside California have rights regarding the sale and sharing of their personal data under applicable state privacy laws. While we do not sell personal data, if you wish to opt out of the sale or sharing of your anonymized and aggregated data, or if you have questions about how your data is used, please contact us at [email protected]. We will honor opt-out requests to the extent required by applicable law in your state.

The following states currently have consumer data privacy laws that may provide you with additional rights: Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. If you are a resident of one of these states and wish to exercise your privacy rights, please contact us at [email protected] with the subject line “State Privacy Rights Request” and we will respond in accordance with applicable law.

9. Data Retention

We retain your personal information for as long as your account is active and as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. This section describes our retention practices for different categories of data.

Account and Dog Profile Data

We retain your account information and dog profile data for as long as your account remains active. If you delete your account, your account information, dog profiles, and associated personal data will be deleted within 30 days of your deletion request, except as described below under Residual Data.

Walk and Location Data

We retain your walk history and location data for as long as your account is active. You may delete individual walks from your account at any time within the app. Walk data associated with deleted walks is removed from your account but may persist in anonymized and aggregated form in our systems. Upon account deletion, all walk and location data associated with your account will be deleted within 30 days.

Social Feed Content

Posts and comments you have made to the social feed are deleted upon account deletion. However, as described in Section 5, posts and comments associated with a deleted dog profile are retained in disassociated form with the dog attribution removed. If you wish to delete individual posts or comments, you may do so within the app before deleting your account.

Gameplay Data

Territory claims, leaderboard standings, and pack contributions associated with your account are removed from the active game state upon account deletion. Some aggregated or anonymized gameplay statistics derived from your activity may persist in our systems in de-identified form.

Communications and Support Records

We retain records of support communications and other correspondence for up to 3 years following the resolution of the relevant inquiry, or longer if required for legal or compliance purposes.

Legal and Compliance Retention

Notwithstanding the above, we may retain certain information for longer periods where required by applicable law, regulation, or legal process, or where necessary to establish, exercise, or defend legal claims. We may also retain de-identified or anonymized data indefinitely for research, analytics, and business purposes.

Deletion Requests

To request deletion of your account and personal data, you may delete your account through the account settings within the app, or submit a deletion request to [email protected]. We will process deletion requests within 30 days and confirm completion. Please note that we cannot recover deleted account data after the deletion process is complete.

10. Data Security

We take the security of your personal information seriously and implement commercially reasonable technical, administrative, and physical safeguards designed to protect your data from unauthorized access, disclosure, alteration, and destruction.

Security Measures

Our security practices include encryption of data in transit using industry-standard TLS protocols, encryption of sensitive data at rest, access controls that limit employee and contractor access to personal data to those who need it to perform their job functions, regular security reviews and vulnerability assessments, and incident response procedures designed to detect and respond to security events promptly.

Location Data Security

Given the sensitive nature of location data, we apply additional controls to the storage and access of walk routes and GPS data. Location data is stored separately from other account data and access is restricted to systems and personnel with a specific operational need.

No Guarantee of Absolute Security

No method of transmission over the internet or method of electronic storage is completely secure. While we work hard to protect your information, we cannot guarantee the absolute security of your data. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

Your Role in Security

You are responsible for maintaining the security of your account credentials. You should use a strong, unique password for your Turf Warz account and not share your login information with anyone. If you believe your account has been compromised, please contact us immediately at [email protected] and change your password through your account settings.

Reporting Security Vulnerabilities

If you discover a security vulnerability in the Service, please report it to us at [email protected] rather than publicly disclosing it. We will investigate all credible reports and work to address confirmed vulnerabilities promptly.

11. Children’s Privacy

We are committed to protecting the privacy of children who use the Service. This section describes our practices with respect to users under the age of 18 and our compliance with the Children’s Online Privacy Protection Act (“COPPA”) and other applicable laws.

Users Under 13

Children under the age of 13 may not create independent accounts or use the Service except through a family account created and managed by a parent or legal guardian. We do not knowingly collect personal information directly from children under 13 outside of the family account framework described below.

If we discover that we have collected personal information from a child under 13 without verifiable parental consent through a properly established family account, we will take immediate steps to delete that information. If you are a parent or guardian and believe your child under 13 has provided us with personal information without your consent, please contact us at [email protected].

Family Accounts and Parental Consent

Parents and legal guardians may create a family account and add children as family members. By creating a family account and adding a child, the parent or legal guardian provides verifiable parental consent for the child’s participation in the Service and consents to the collection, use, and sharing of the child’s personal information as described in this Privacy Policy.

The parent or legal guardian who creates a family account has full visibility into and control over all activity, settings, and data associated with every family member in the account, including minor children. This includes walk routes and walk data, territory claims, social feed posts, buddy interactions, privacy settings, and gameplay data and stats for each family member. This parental visibility is displayed in the account settings and cannot be restricted by family members. This parental oversight is a core feature of the family account and is maintained for the duration of the account.

Users Ages 13 to 17

Users between the ages of 13 and 17 may only use the Service through a family account managed by a parent or legal guardian as described in our Terms of Service. We do not use the personal data of users under 18 for sponsored challenge participation or promotional communications without verifiable parental consent.

Parental Rights

Parents and legal guardians have the right to review the personal information we have collected about their child, request correction of inaccurate information, request deletion of their child’s personal information, and withdraw consent for further collection or use of their child’s personal information. To exercise these rights, contact us at [email protected]. Please note that withdrawing consent or requesting deletion of a child’s information will result in that child’s inability to use the Service.

12. Your Rights and Choices

You have a number of rights and choices regarding your personal information. This section describes those rights and how to exercise them.

Access and Portability

You have the right to request access to the personal information we hold about you. You can access much of your information directly through your account settings within the app, including your dog profiles, walk history, and privacy settings. To request a copy of your personal data in a portable format, contact us at [email protected] with the subject line “Data Access Request.” We will respond within 30 days.

Correction

You have the right to correct inaccurate personal information we hold about you. You may update your account information, dog profile information, and privacy settings directly within the app at any time. For corrections to information you cannot update yourself, contact us at [email protected].

Deletion

You have the right to request deletion of your personal information. You may delete your account at any time through your account settings within the app. You may also delete individual walks, dog profiles, and social feed posts within the app. For a full account deletion request, contact us at [email protected]. We will process deletion requests within 30 days as described in Section 9.

Privacy Settings

You have granular control over how your information is shared within the Service through the privacy settings described in our Terms of Service. These settings include Territory Visibility, Territory Masking, Profile Visibility, Walk Share Default, Walk Obfuscation Radius, Leaderboard Opt-In, and Buddy Request controls. You may change any of these settings at any time within the app.

Opt-Out of Promotional Communications

You may opt out of receiving promotional emails and push notifications sent directly from Turf Warz at any time by following the unsubscribe instructions in any promotional email we send, or by contacting us at [email protected]. Please note that even if you opt out of direct promotional communications, we will continue to send you service-related notifications necessary to operate your account and provide the Service.

The Service may in the future display sponsored content, promoted posts, or brand integrations within the app experience. This type of in-app content is part of the Service itself and is not subject to the opt-out described above. We will disclose the sponsored nature of any such content clearly within the app.

Push Notifications

You may control push notifications from the Service through your device’s notification settings at any time. Disabling push notifications may affect your ability to receive walk reminders, family walk alerts, and other gameplay notifications.

Location Permissions

You may revoke the Service’s access to your device’s location at any time through your device settings. As described in Section 4, revoking foreground location permission will disable core gameplay features and revoking background location permission will disable walk tracking when the app is not in the foreground and family walk notifications.

Account Deletion

Deleting your account is permanent and cannot be undone. Upon account deletion your personal data will be deleted within 30 days as described in Section 9. If you are the owner of a family account, deleting your account will also delete all associated family member data. We recommend that you export any data you wish to retain before deleting your account.

Exercising Your Rights

To exercise any of the rights described in this section, you may use the controls available within the app or contact us at [email protected]. We will respond to all requests within 30 days. We may ask you to verify your identity before processing certain requests to protect the security of your account.

13. Communications and Notifications

We may send you the following types of communications in connection with your use of the Service.

Service Communications

Service communications are notifications necessary to operate your account and provide the Service. These include account creation and verification messages, password reset requests, subscription confirmation and renewal notices, purchase receipts, account suspension or termination notices, security alerts and notifications of unauthorized account access, and updates to these Terms, this Privacy Policy, or our Community Guidelines. You cannot opt out of service communications while your account is active as they are necessary to provide the Service.

Gameplay Notifications

Gameplay notifications are in-app and push notifications related to your activity within the Service. These include territory challenge alerts, rival activity notifications, leaderboard updates, pack activity notifications, walking buddy suggestions, walk reminders, weather warnings, rest break reminders, and family walk notifications. You may control gameplay notifications through your device’s notification settings and through the notification preferences available within the app.

Promotional Communications

Promotional communications are direct messages from Turf Warz about new features, seasonal events, challenges, and other offers. These are sent by email or push notification and are separate from sponsored or brand content displayed within the app. You may opt out of promotional communications at any time as described in Section 12. Opting out of promotional communications does not affect service communications or gameplay notifications.

In-App Sponsored Content

The Service may in the future display sponsored content, promoted posts, or brand integrations as part of the in-app experience. This content will be clearly labeled as sponsored. In-app sponsored content is part of the Service experience and is not a direct communication from Turf Warz to you. As described in Section 12, in-app sponsored content is not subject to the promotional communications opt-out.

Legal Basis for Communications

We send service communications on the basis that they are necessary to perform our contract with you. We send gameplay notifications and promotional communications on the basis of your consent, which you may withdraw at any time as described in Section 12.

14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our data practices, the Service, or applicable law. When we make changes we will notify you via in-app notification before the changes take effect. The updated Privacy Policy will be made available within the app and the effective date at the top of the document will be updated.

For material changes — meaning changes that significantly affect how we collect, use, or share your personal information — we will provide advance notice of at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any updated Privacy Policy constitutes your acceptance of the changes. If you do not agree with the updated Privacy Policy, you must stop using the Service and may delete your account as described in Section 12.

We will maintain prior versions of this Privacy Policy and make them available upon request by contacting us at [email protected].
